How Does a Trade License Work?

A trade registration is required in India before you can legally start a business. A trade license allows an applicant to start a business legally in a specific area or location. India’s state governments have the power to authorize the establishment of a business. Licensing is handled by the licensing department of the Municipal Corporation.

Does India have a Trade License application process?

To apply for a trade license, a person must meet the following requirements:

* Citizens of India must apply

* A minimum age of 18 is required for applicants

* In order to operate a business, the Applicant must be legally permitted to do so

* It is important that the business is legal

* A trade license application must be submitted 30 days after the business begins.

What is the process for applying for a trade license in India?

The following steps will help you apply for a trade license:

* Check out the official website of the state where your business will be located. 

* All the required documents must be attached to a simple online application form.

* On completion of the application and one can submit the documents.

Your application and uploaded documents will then be reviewed by the Municipal Corporation. The application usually takes up to 12 working days to process. The same website allows you to check the status of your application. Obtaining a trade license will be granted if the authority deems your application successful.

Requirements for documents

Documents needed include:

* Photographs of the applicant that are passport-sized

* The applicant’s Aadhar card

* The trade building layout plan certified by the building department.

* Copy of PAN card

* If you are applying for a firm, limited liability company, or company, you must submit a Certificate of Incorporation

* A copy of the most recent municipal property tax receipt

* An immediate neighbor’s NOC

* Owner’s consent letter

* Leasing documents

* Certificate of Occupancy (OC)

* A sanctions plan has been developed

* A copy of the Katha Certificate with extracts.

Do Indians face penalties for violating their trade license?

Businesses that hold a trade license are required to follow the rules and regulations laid out in the license. If the owner or the business does not comply with the terms, they could be subject to strict penalties. 

Penalties for violating the trade license provisions include:

* Persons who begin business without a Trade License may be subject to fees and penalties. The business could also be shut down as a result.

* Violations of the trade license would include causing a nuisance in the neighborhood. Licenses may be revoked or canceled in such cases. 

* In the event that the entity violates the terms or laws of the trade license, a prescribed penalty may be imposed. 

* A fine of 50% of the license fee may be imposed if the trade license is not renewed on time. 

* Depending on the circumstances, appropriate legal action may need to be taken against the defaulting party.
